1. Introduction:

This document sets out our complaints policy. If you are a User of Facedownassup.com, this Complaints Policy forms part of your agreement with us.

2. Interpretation:

If you have a complaint about Facedownassup.com, (including any complaint about Content appearing on Facedownassup.com, or the conduct of a User), please submit your complaint by completing our online form on this page. You are required to complete all mandatory fields, provide a description of your complaint and, if your complaint relates to Content, the URL for the Content to which your complaint relates.

5. How We deal with complaints of illegal or non-consensual content:

Following receipt of your complaint of Illegal or Non-Consensual Content under section 4 above:

• We will take such steps as we consider to be appropriate resolve your complaint within 7 business days.
• If we require further information or documents from you, we will contact you to let you know.
• We will in good faith investigate your complaint and take the following action:
• If we are satisfied that the Content is unlawful or non-consensual, we will immediately remove such Content, and we will notify you of our decision by email or other electronic message.
• If we are satisfied that the Content is not unlawful or non-consensual, we will notify you of our decision by email or other electronic message.

Any dispute regarding our decision on non-consensual content will be submitted by us to a neutral arbitration association at our expense.

6. How we deal with complaints related to copyright infringement:

Complaints related to copyright infringement will be responded to in a timely manner.

7. How we deal with other complaints:

Following receipt of other complaints (including complaints related to other breaches of our Acceptable Use Policy) under section 4 above:

• We will take such steps as we consider to be appropriate to investigate your complaint within a timescale which is appropriate to the nature of your complaint.
• If we require further information or documents from you, we will contact you to let you know.
• We will in good faith take such actions as we consider appropriate to deal with the issue which your complaint has raised. If you have complained about content which appears on Facedownassup.com and we are satisfied that the content otherwise breaches our websites policies, we will act quickly to remove such content.
• We are not obligated to inform you of the outcome of your complaint.

8. Unjustified or abusive complaints:

If you are a User of Facedownassup.com, you warrant that you will not make any complaint under this Complaints Policy which is wholly unjustified, abusive, or made in bad faith. If we determine that you have breached this warranty, we may suspend or terminate your User account.

9. There are no third-party user-uploads. All content is produced by us:

We produce all content ourselves with our production partners but ultimately we do inspect all documentation including model release forms and ID scans.

10. All content is manually reviewed before publishing:

We ensure the IDs and model releases match up to the models appearing in the videos, and we further review the content to ensure there is nothing prohibited.

11. Prohibited Content:

In addition to ensuring the people appearing in the content are verified and of age, we also review for the following types of material that are prohibited:

• Content that simulates anything under the age of 18, which includes depicting or describing anyone as under the age (even if in reality, they are).
• Any use of the word “teen” has to be clearly and conspicuously state they are 18 or 19 years old.
• Any sort of simulated forced or non-consensual activity, which includes anyone appearing to be or simulated to be drunk, sleeping, hypnotized, or not of clear mind to consent.
• We further review the description and text around any content appearing on our site that could elicit or describe the content as being any sort of simulated or actual forced or non-consensual activity.
• Anything that depicts or describes content with human feces.
• Any content with actual or depiction of extreme violence, sexual violence mutilation, or pain.
• Any content that displays counterfeit or copyright-infringing merchandise.
• Any content whereby objects are used as sex objects, and their intended use is NOT a sex object.
• Any sort of harassment, hate crimes, acts of degradation, etc.

12. Trafficking Monitoring:

We only work with producers who work with established model talent agencies in the industry.
